Overviewโ€‹

Thirdrez respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA) and equivalent international copyright laws. This policy explains how to report copyright infringement and how we handle such reports.


1. Our Commitmentโ€‹

1.1 Zero Tolerance for Piracyโ€‹

We do not tolerate:

  • Uploading copyrighted content without authorization
  • Distributing pirated animation files
  • Circumventing digital rights management (DRM)
  • Claiming ownership of others' creative work

2. Submitting a Takedown Noticeโ€‹

2.1 Who Can Submitโ€‹

You may submit a DMCA takedown notice if you are:

  • The copyright owner
  • Authorized to act on behalf of the copyright owner

2.2 Required Informationโ€‹

A valid DMCA notice must include:

- Full legal name
- Mailing address
- Phone number
- Email address

2. IDENTIFICATION OF COPYRIGHTED WORK
- Description of the original work
- URL or location where your work appears (if online)
- Copyright registration number (if registered)

3. IDENTIFICATION OF INFRINGING MATERIAL
- URL(s) on Thirdrez where infringing content appears
- Specific description of the infringing content

4. STATEMENTS (REQUIRED)
- "I have a good faith belief that use of the copyrighted
material described above is not authorized by the copyright
owner, its agent, or the law."

- "I swear, under penalty of perjury, that the information in
this notification is accurate and that I am the copyright
owner, or am authorized to act on behalf of the owner."

3.2 What We Doโ€‹

Upon receiving a valid DMCA notice:

  1. Review โ€” Verify the notice meets legal requirements
  2. Disable โ€” Remove or disable access to allegedly infringing content
  3. Notify โ€” Inform the user who uploaded the content
  4. Preserve โ€” Maintain records for potential disputes
  5. Document โ€” Log the incident for repeat infringer policy

3.3 Repeat Infringer Policyโ€‹

We terminate accounts of repeat infringers:

Good Faith Consideration

We consider counter-notices and context. Accidental or disputed claims don't automatically count as strikes.


4. Counter-Notificationโ€‹

4.1 When to Fileโ€‹

You may file a counter-notice if you believe:

  • You are the actual copyright owner
  • You have authorization to use the content
  • The content is fair use
  • The takedown was filed in error

4.2 Required Informationโ€‹

A valid counter-notice must include:

2. IDENTIFICATION OF REMOVED MATERIAL
- Description of content that was removed
- URL where it appeared before removal

3. STATEMENT OF GOOD FAITH
- "I swear, under penalty of perjury, that I have a good
faith belief that the material was removed or disabled
as a result of mistake or misidentification."

4. CONSENT TO JURISDICTION
- "I consent to the jurisdiction of the Federal District
Court for the judicial district in which my address is
located, or if outside the United States, the jurisdiction
of courts in Brazil, and I will accept service of process
from the complainant."

5. Misuse Warningsโ€‹

5.1 False Takedown Noticesโ€‹

Filing a false DMCA notice is perjury under U.S. law. Consequences include:

  • Civil liability for damages
  • Attorney's fees
  • Potential criminal prosecution
  • Account termination on Thirdrez

5.2 False Counter-Noticesโ€‹

Similarly, filing a false counter-notice:

  • Constitutes perjury
  • May result in civil liability
  • Could expose you to the original lawsuit
Legal Consequences

DMCA notices and counter-notices are legal documents filed under penalty of perjury. Consult an attorney if you're unsure about your rights.


6. Special Considerationsโ€‹

MotionPrint establishes provenance but does not grant copyright:

  • A MotionPrint registration doesn't prove you own the copyright
  • Original copyright always supersedes MotionPrint claims
  • Registering copyrighted content you don't own is a violation

6.2 AI-Generated Contentโ€‹

For content created with Kinetiq Engine:

  • You generally own AI-generated outputs (subject to terms)
  • Base training data remains our IP
  • Disputes over AI authorship are handled case-by-case

6.3 User-Generated Marketplace Contentโ€‹

For marketplace submissions:

  • Uploaders warrant they have rights to sell
  • We're not liable for infringement by sellers
  • We respond promptly to valid takedowns

7. International Usersโ€‹

7.1 Non-US Usersโ€‹

While we follow DMCA procedures, we also respect:

  • EU: Directive 2001/29/EC, DSM Directive
  • Brazil: Lei de Direitos Autorais (Law 9.610/98)
  • UK: Copyright, Designs and Patents Act 1988
  • Canada: Copyright Act

7.2 Jurisdictional Mattersโ€‹

  • We apply the most restrictive interpretation
  • Legal disputes follow our Terms of Service jurisdiction
